A very limited form of single-game wager has actually been available inside four upstate casinos since 2013. But now, both online and retail in-person sports wagering are legal in New York state.

In July 2019, sports betting launched inside two NY tribal casinos – Rivers Sportsbook and FanDuel Sportsbook at Tioga Downs. However, it was almost two and half years later before online sports betting went live in the Empire State, which finally took place in January 2022.

History and updates of sports betting in New York

To start us off, here is a timeline where I have highlighted all of the major events in the New York sports betting journey so far. If and when any new landmark moments arise, I will add them at the earliest opportunity – so be sure to bookmark this page for updates.

  • 13 February 2024 – PENN secures a deal to bring its mobile sportsbook, ESPN Bet, to New York. The launch is planned for late 2024 subject to approval and licensing from the New York Gaming Commission (NYGC).
  • 15 November 2023 – The Bally Bet Sportsbook re-launches in New York following a five-month shutdown due to changing its software platform.
  • 27 February 2023 – The NYGC approves rule changes for legal sports betting-related advertising and marketing.
  • 17 January 2023 – The Senator files the SB 1962 bill, which would allow an increase to 14 online sportsbook licenses by 2024 and 16 by 2025 if passed.
  • 07 July 2022 – Bally Bet launches to become the ninth and (at the time) final online sportsbook in NY state.
  • 06 April 2022 – Caesars Sportsbook announces a betting partnership with the New York Mets
  • April 2022 – FanDuel becomes the official betting partner of the New York Yankees.
  • 23 February 2022 – FanDuel announces a betting partnership with the Buffalo Sabres.

The minimum legal age to place any form of sports bet in New York is 21 (online and in-person). Before you get started, here are a few essential points that you should know first:

  • Legal age limit – As I said above, the minimum legal age for New York sports betting is 21 years. This should not be confused with the 18+ limit that only applies to pari-mutuel horse racing wagers and lottery tickets.
  • Mobile sports betting – Online and mobile sports wagering has been legal in the Empire State since 2022. There are currently nine mobile sportsbooks with a 10th set to launch in 2025.
  • Remote registration – Rather than having to visit an in-person sportsbook you can register and verify your account entirely remotely with your ID and SSN.
  • Within state borders – To place an online/mobile sports bet, you must be physically located within state borders. New York sportsbooks use geolocation technology and blockers to enforce this.
  • Retail sportsbooks – As you can see in the table above, there are 11 retail sportsbooks inside commercial and tribal casinos. These are all located upstate, but there are plans in the works for an NYC casino and sportsbook in Manhattan – so watch this space.
  • Taxable winnings – As a New York resident, you will be taxed 8.82% on sports betting winnings of more than $5,000. Additionally, the standard 24% federal tax also applies.

How to read the odds

Pretty much all New York sportsbooks use American odds format as the default display, which you should find is the easiest to read. There are two numbers that you need to understand – plus and minus.

  • The underdog will usually be at plus odds, which shows your expected profit with a $100 stake. E.g. Knicks to beat the Lakers at +200.
  • The favorite is normally offered at a minus odds price, which shows how much you would need to stake to get a $100 expected profit. E.g Nets to beat the Spurs at -150.

What can you not bet on in New York?

When betting on sports in New York a few things are still illegal. For example, you won’t find markets on any of the following at an NY retail or online sportsbook:

  • Politics – Betting on political events is prohibited by the NYGC and all other US state sports betting regulators.
  • Entertainment and awards – Novelty markets, such as the Oscars and Grammys, are prohibited from sportsbooks.
  • Esports – There is no specific mention of esports betting in New York state law or the NYGC regulatory rules, which basically renders it illegal by default.
  • Under-18 athletes – As in all other US states, it is illegal to wager on high school sports and anything that involves amateur athletes under the age of 18 in the Empire State.

What about college sports

You can bet on any college games involving out-of-state teams so long as the event isn’t taking place within New York state borders. Betting on NY-based collegiate teams or college sports games being played in New York is illegal.

I have covered all of the rules and regulations surrounding sports betting in the Empire State at some point in this article. But as you will have gathered by now, I’m a fan of putting together summaries and lists to provide you with an easy and quick reference point.

With that in mind, here are the most important laws for NY sports betting:

  • Nine sportsbooks have been licensed with a 10th on the way which will take it to the current maximum limit.
  • Online sportsbooks in New York are taxed at 51% of their gross revenue, the highest in the US.
  • Retail sportsbooks are taxed at 10% of their gross revenue.
  • You must be 21 or older to bet on sports in New York, either in person or remotely.
  • It is prohibited to wager on college sports games taking place in New York or involving NY-based collegiate teams.

Other types of gambling in New York

Do you want to know more about gambling in New York in general? Let’s take a break from sports betting for a minute and look at other forms of gambling:

Casinos

There are nine tribal casinos located throughout New York state, as well as four upstate commercial casinos that opened in 2013. In total, you have around a dozen options when it comes to land-based casino gaming in the Empire State, but none of them are located in and around the city.

As in most states, real money online casinos remain illegal in New York. However, you do have alternatives in the form of sweepstakes casinos such as Wow Vegas and Stake.us.

Poker

Most of the tribal and commercial casinos in upstate New York have real money poker rooms where you can play in person. Online real money poker remains illegal, with no plans to legalize it currently in the pipeline.

Horse racing betting

Betting on horse races (online and in-person) is legal in the Empire State. There are three racetracks as well as multiple off-track (OTB) betting locations. Additionally, you can access a number of betting sites dedicated only to horse racing.

Daily fantasy sports (DFS)
